What is a Nomination of Committee?
A nomination of committee is a legal document that appoints one or more people to manage a person’s financial and healthcare decisions if they lose mental capacity.
It tells the court who you want to be appointed as your committee in the event someone makes a court application to be appointed to your committee.
In British Columbia, if an adult becomes mentally incapable, any person may apply to the Supreme Court of British Columbia to be appointed as a committee of the adult’s estate or as a committee of the person. The former allows the applicant to handle the adult’s financial and legal affairs. The latter allows the applicant to handle the adult’s health and personal care matters.
These costly and time-consuming applications may be necessary when an adult becomes mentally incapable and they did not do any prior incapacity planning, such as creating an enduring power of attorney, representation agreement, and/or an advance directive.
It is generally better for you to make an enduring power of attorney, a section 9 representation agreement, and/or advance directive while you have the capacity to do so.
